Acceptable Use Policy (AUP)
These principles (hereinafter the "AUP") define what is and is not acceptable when using the VPS hosting service of Exascale.cz (hereinafter the "Service"). They form an integral part of the contractual relationship alongside General Terms and Conditions a Personal Data Processing PrinciplesBreach of the AUP constitutes a material breach of contract.
1. Scope and customer responsibilities
- The customer is responsible for all activity on their VPS, the content they store and distribute on it, and the actions of any individuals to whom they grant access to the VPS.
- The customer is obliged to keep their system secure (updates, strong passwords, closing unnecessary services). The customer is responsible for any misuse of an unsecured server by a third party.
2. Prohibited content and activities
The Service prohibits storing, distributing or providing access to:
- content violating the legal order of the Czech Republic and the EU;
- material exploiting children (immediate termination and notification of criminal justice authorities without prior warning);
- content infringing copyright and intellectual property rights (warez, illegal streaming, torrents with protected content);
- material inciting violence, terrorism or hatred against groups of persons;
- fraudulent content (phishing, fake e-shops, scams, fraudulent investment offers).
3. Network abuse
Prohibited in particular are:
- sending unsolicited mail (spam), including operating open mail relays and running mass campaigns without verifiable consent from recipients;
- port scanning, penetration attempts and unauthorised access to third-party systems;
- DoS/DDoS attacks, IP/DNS spoofing, header forgery;
- operating C2 infrastructure, botnets and malware distribution;
- Activities leading to the inclusion of IP ranges in service blacklists.
4. Email and distribution
- Bulk mailing is possible only on the basis of verifiable opt-in consent with a functional unsubscribe option.
- The operator may impose limits on outgoing messages and require correctly configured SPF/DKIM/DMARC and rDNS (PTR).
- The reverse DNS record (PTR) for an IP address is set by the operator; customers must request changes via support.
5. Server sources and fair use
- The customer must not jeopardise the stability of shared infrastructure (host node, network, storage) through their activities.
- Cryptocurrency mining and other forms of continuous maximum CPU/IO load are permitted only on plans that explicitly allow it, or following a written agreement.
- The operator may temporarily restrict the resources of a VPS that demonstrably harms other customers.
6. Procedure in case of a breach
Depending on severity, the operator:
- alerts the customer and sets a deadline for remediation (for less serious violations);
- suspend VPS (in cases of continuing or serious breach);
- immediately terminate Service without compensation (for the most serious violations, material exploiting children, active attacks, threats to infrastructure, repeated violations).
In urgent cases (ongoing attack, legal obligation), the operator may act without prior notice. The operator cooperates with public authorities to the extent prescribed by law.
7. Reporting abuse
Report suspected misuse to exascale.cz abuse@exascale.cz. In your report, please include the IP address, time (including time zone), and a description. We process reports without unnecessary delay.
8. Changes to the Terms
The operator may update the AUP. Customers will be notified in advance of any material changes (via email or through the administration). By continuing to use the Service, the customer indicates their acceptance of the changes.
